    Who is legally required to have a fire risk assessment?
    Under the Regulatory Reform (Fire Safety) Order 2005, every non-domestic premises in England and Wales must have a suitable and sufficient fire risk assessment. This includes offices, shops, factories, warehouses, HMOs, residential blocks (common areas), schools, care homes, hotels, restaurants, churches, and any other workplace or public building. The responsible person — typically the building owner, landlord, employer, or managing agent — is legally responsible for ensuring the assessment is carried out and kept up to date.
    What is PAS 79:2020 and why does it matter?
    PAS 79:2020 is the current British Standard published specification for fire risk assessment, issued by BSI. It sets out the methodology and reporting format that competent assessors should follow. A fire risk assessment that follows PAS 79:2020 is widely recognised as meeting the standard expected by fire authorities, insurers, and courts. If your existing assessment does not follow PAS 79, it may be considered inadequate.
    How long does a fire risk assessment take?
    The on-site assessment typically takes 2-4 hours for a standard commercial premises. Larger or more complex buildings — multi-storey offices, schools with multiple buildings, or residential blocks with extensive common areas — may require a full day or more. The PAS 79:2020 report is delivered within 5 working days of the site visit.
    How often should a fire risk assessment be reviewed?
    There is no single legal frequency, but the RRO 2005 requires the assessment to be reviewed regularly. Industry guidance and most fire authorities recommend an annual review as a minimum. A review should also be triggered by any significant change — building alterations, change of use, increased occupancy, a fire incident, or if the existing assessment is no longer considered valid. Many insurers require annual reviews as a condition of cover.
    What happens if I do not have a fire risk assessment?
    You are in breach of the Regulatory Reform (Fire Safety) Order 2005. The local fire authority can issue an enforcement notice requiring you to comply, an alterations notice restricting changes to the building, or a prohibition notice preventing the use of the building entirely. In serious cases, the responsible person can be prosecuted, with unlimited fines and up to 2 years imprisonment. Following the Grenfell Tower fire, enforcement activity has increased significantly.

    A fire risk assessment is the formal, legal assessment required under the RRO 2005, identifying fire hazards, evaluating risks, and recommending controls. A fire safety audit is typically a broader operational review carried out by a fire authority or insurer.
